In a decisive move to stem a potential 'brain drain' from India legal profession, the Supreme Court has mandated the creation of a 'Young Lawyers' Professional Assistance Fund' across all states and Union Territories. The directive, issued by a bench comprising Chief Justice of India Surya Kant and Justice V. Mohana, responds to the escalating crisis of economic hardship faced by young legal talent. The legal profession in India has long presented an arduous path for new entrants, marked by intense competition, insufficient initial earnings, and a lack of structured support, particularly for those without familial connections in law. This often forces promising young advocates to seek opportunities abroad or in other sectors, leading to a significant exodus of talent. The Supreme Court observed that many junior advocates rely on modest stipends, often insufficient for basic living expenses, exacerbating financial anxiety and hindering professional growth. This concern was highlighted in a petition filed by women lawyers, which broadened the court's focus beyond infrastructure to the economic vulnerability of junior advocates. The Supreme Court has given the Bar Council of India and all State Bar Councils a three-month deadline to establish this fund and six weeks to submit a comprehensive action plan. The proposed funding mechanisms include contributions from successful senior lawyers, a portion of court fees, and costs imposed in judicial proceedings, with tax exemptions suggested as an incentive for donors. This intervention signals a critical push towards institutionalizing support for young legal professionals, with the Supreme Court expected to closely monitor its implementation to ensure the vibrancy and future of India justice system.
